Time Capsule Party Hire – Terms and Conditions

This Agreement is made between:
Time Capsule Party Hire (“the Company”, “we”, “us”) and The Hirer (“you”, “your”).
By signing this Agreement, you agree to the following Terms & Conditions:
1. Bookings and Payment
- Full payment is required at the time of booking via Square invoice.
- Bookings are only confirmed once payment has been received.
- The Supplier reserves the right to change prices/specials on the site at any time without notice.
2. Cancellations and Refunds
- More than 2 weeks before event: Full refund.
- At least 48 hours before event: 50% refund.
- Within 48 hours of event: No refund.
- If we cancel, a full refund will be provided.
- If the event is affected by extreme weather or safety risks (torrential rain, hail, strong winds, flooding, thunderstorms, earthquake, terrorist-related restrictions), we may reschedule delivery. If rescheduling is not possible, a refund will be issued.
3. Delivery, Collection, and Pickup
- Customers may either collect equipment or arrange delivery/collection, please note that collection is not available for selected equipment.
- Delivery fees may apply and will be advised before booking.
- Customers must provide safe and clear access for delivery and collection.
- Failure to return equipment or inability for drivers to access equipment will incur a daily charge beyond the agreed hire period.
- The hirer is responsible for having someone available to take delivery of the equipment at the nominated date and time. If not, an additional delivery fee will apply for re-delivery.
- Late returns may incur additional charges.
4. Customer Responsibilities
- Hirer must be 18 years or older.
- Adult supervision is required for all equipment.
- The hirer will watch all relevant instructional videos and take responsibility for safe operation of equipment
- Equipment must be used safely and as instructed.
- Hirer is responsible for any injury, accident, or damage caused by misuse or lack of supervision.
- The hirer accepts full responsibility for the equipment once they take possession.
- The hirer may not transfer this contract to another party without written consent of the Supplier.
5. Damage, Loss, and Cleaning
- Equipment remains the property of Time Capsule Party Hire.
- The hirer is liable for any damages, loss, theft, vandalism, or weather-related damage.
- Repair or replacement costs will be charged to the hirer where equipment is stolen, missing, vandalised or broken.
- No refunds are provided in the event of weather damage or vandalism.
- A cleaning cost may be charged to the hirer if the equipment is returned excessively dirty, beyond normal use.
- The hirer must inspect all equipment at delivery and notify the Supplier immediately if equipment is missing, damaged or unfit for use.
6. Liability and Insurance
- We hold $20 million Public Liability Insurance.
- We are not liable for injuries, damages, or accidents caused by improper use or lack of supervision.
- The hirer indemnifies Time Capsule Party Hire against all claims, demands, losses, suits, or liabilities (including legal costs) arising from use of the equipment, except where required by law.
7. Privacy
- Personal information is handled in accordance with our Privacy Policy (available on our website).
8. Governing Law
- This Agreement is governed by the laws of Victoria, Australia.
- Venue for any legal proceedings shall be in VIC.
- Any invalid provision will not affect the rest of this Agreement and shall be modified to remain enforceable.
- This Agreement binds and benefits the heirs, successors and assignees of the parties.
- The terms and conditions can only be amended in writing, signed by both Hirer and Supplier.
- Oral agreements are non-binding.
- The latest contract supersedes all previous contracts between Hirer and Supplier.
